Penelitian ini bertujuan untuk mengkaji praktik pemenuhan hak anak pasca perceraian di Desa Kerandon, Kecamatan Talun, Kabupaten Cirebon, melalui perspektif Qira’ah Mubadalah [[Faqihuddin Abdul Kodir]] dan Maqashid Syariah. Terdapat tiga fokus utama dalam penelitian ini: (1) bagaimana praktik pemenuhan hak anak pasca perceraian di tingkat lokal, (2) bagaimana nilai-nilai kesalingan (mubadalah) diterapkan dalam relasi orang tua pasca perceraian, dan (3) bagaimana prinsip-prinsip maqashid syariah direfleksikan dalam pemenuhan hak-hak anak. Metode penelitian yang digunakan adalah kualitatif deskriptif dengan pendekatan normatif-sosiologis. Data diperoleh melalui wawancara dengan lima keluarga yang telah bercerai dan memiliki anak, observasi, serta studi dokumen. Analisis data menggunakan model Miles dan Huberman yang mencakup tahap reduksi data, penyajian data, dan penarikan kesimpulan. Hasil penelitian menunjukkan bahwa praktik pemenuhan hak anak pascaperceraian sangat dipengaruhi oleh faktor sosial, ekonomi, dan kualitas hubungan antara kedua orang tua. Dalam beberapa kasus, prinsip Qira’ah [[Mubadalah]] seperti musyawarah dan taradhin dapat diinternalisasi melalui komunikasi yang produktif dan kolaboratif antara orang tua. Namun, terdapat pula situasi yang menunjukkan kegagalan dalam pemenuhan hak anak karena putusnya komunikasi dan abainya salah satu pihak. Dari perspektif maqashid syariah, ditemukan bahwa sebagian keluarga tetap menjaga prinsip perlindungan terhadap agama, jiwa, akal, keturunan, dan harta anak, meskipun dalam keterbatasan. Penelitian ini menegaskan pentingnya pendekatan berbasis kesalingan dan perlindungan maqashid dalam merancang kebijakan dan praktik perlindungan anak pasca perceraian.

Quraish Shihab towards sexual relations between husband and wife with modern family life. This study uses a qualitative research method with a comparative descriptive approach. Data processing uses editing, classification and conclusions from the data of the interpretation of the Qur'an al-adzim and interpretation of al-misbah. The results of the research on the concept of sexual relations between husband and wife towards family happiness according to Ibn Kathir and M. Quraish Shihab are both oriented towards worship and family happiness. If analyzed through the theory of Mubadalah and Maqasid al-Syari'ah, both complement each other in building the concept of sexual relations that are humane, fair, and foster family happiness. The similarities between the two scholars emphasize that sexual relations are part of worship that must be carried out with manners and mutual respect and play an important role in maintaining household harmony, while the differences are that Ibn Kathir is more normative, protected by sharia, and based on classical fiqh while M. Quraish Shihab is more flexible, adding emotional aspects, considering social and psychological aspects in contemporary families. The relevance of Ibn Kathir and M. Quraish Shihab's thoughts on sexual relations in the context of modern families, their thoughts can complement each other, Ibn Kathir's emphasis on wife's obedience can be interpreted as a shared responsibility to maintain harmony and M. Quraish Shihab's approach emphasizes compassion and equality which are relevant in facing the challenges of modern families where communication and mutual understanding are the main keys. By combining these two perspectives, a married couple can build a harmonious relationship, mutual respect, and in accordance with Islamic values in the context of the family.''

Abstract

Sexual relations in the household, according to Ibn Katsir and M. Quraish Shihab, are an important part of achieving family happiness, although both have different emphases according to their background and context of interpretation. The formulation of the problem of this research is how the concept of sexual relations between husband and wife towards family happiness according to Ibn Katsir and M. Quraish Shihab, how the similarities and differences of Ibn Katsir and M. Quraish Shihab's thoughts on sexual relations in marriage, how the relevance of Ibn Katsir and M. Quraish Shihab's thoughts on sexual relations between husband and wife to modern family life.
